The US Food and Drug Administration is cracking down on alcoholic energy drinks, ordering four makers of caffeinated alcoholic beverages to either stop putting caffeine in the drinks or stop making them altogether. The order, issued Wednesday, gives the companies fifteen days to comply.
FDA Commissioner Margaret Hamburg said the drinks appear to pose a serious public health risk because the caffeine masks the effect of the alcohol. A recently concluded, year-long review found no evidence that the drinks were safe, so the FDA has pronounced that caffeine is now an illegal additive in alcoholic beverages.
The FDA sent warning letters out to the four companies, saying that drinking the beverages could lead to “hazardous and life-threatening situations.” The letter also threatened further action such as seizing product off store shelves and asking a judge to halt distribution should the companies fail to comply with FDA's order.
Among the companies to receive the letters is Phusion Products, which makes Four Loko, the top-selling of the caffeinated alcoholic drinks, Charge Beverages Corp., New Century Brewing Co., and united Brands Company Inc. The four companies have also received a warning from the Federal Trade Commission regarding their marketing tactics.
The drinks have enjoyed increasing popularity in recent months, and a number of reports have surfaced about young people falling ill after drinking them. Four Loko, which has as much caffeine as a cup of coffee and 12 percent alcohol by volume, came under scrutiny after several students had to be taken to emergency rooms after consuming the beverage and had high levels of alcohol poisoning.
A handful of states, including Washington and Michigan, have banned the drinks in recent weeks, and more are reportedly considering taking that action.
